1. PROMOTER AND PROMOTION

(a) This Promotion is organised by XIAOMI TECHNOLOGIES MALAYSIA SDN. BHD. (The “Promoter”) a company with its business address at Suite 21-2, Level 21, UOA Corporate Tower, Level 21, Avenue 10, The Vertical, Bangsar South City, No. 8, Jalan Kerinchi, 59200 Kuala Lumpur.

(b) The terms and conditions of this Promotion can be accessed via our website (www.mi.com/my) .

(d) The participation of this Promotion implies both the acceptance of all the provisions of these terms and conditions as well as of the general purchase conditions applicable in mi.com/my.

2. TERM

This Promotion shall commence on 12:00 11 April 2024 (GMT+7, 24-Hour Clock) and ends on 23:59 on 30 April 2024 (GMT +0, 24-Hour Clock) ("Promotional Period") or until stock lasts whichever occurs first. The Promoter reserves the right to shorten or extend the Promotional Period at any time without notice to the Participant.

3. TERRITORY

The Promotion is only valid in Malaysia, via mi.com/my and our Mi Store APP.

4. PARTICIPANTS

(a) This Promotion is available to all Malaysian residents aged 18 years and above as of 11 April 2024 ("Participant(s)").

(b) Participants must hold an account or be registered users on mi.com ("Site") and consent to mi.com's terms and conditions (https://www.mi.com/my/about/terms/) and Privacy Policy (https://www.mi.com/my/about/privacy/). Alternatively, Participants may create a personal account to engage in this Promotion by furnishing the following personal details: full name, email address, postal address, and telephone number.

(c) Employees of Promoter, their immediate families, Xiaomi’s dealers, partners, advertising, creative and public relations agencies, program organizer, their employees and immediate families is not eligible to participate in this Promotion.

(d) By participating in this Promotion, Participants agree to be bound by this terms and conditions and all decisions by the Promoter shall be final and binding. For avoidance of any doubt, the Promoter’s decisions are final and that no appeals shall be entertained and/or allowed. By participating in this Promotion, Participants hereby agrees to not resort to court proceedings to review or appeal Promoter’s decision.

5. MECHANICS OF THE PROMOTION

(a) Participants can access the Promotional page via the following link https://www.mi.com/my/store/. During the Promotional Period, customers who purchase selected Xiaomi products will be eligible to receive the following two Promotions, subject to the terms and conditions outlined in Sections 6 and 7.

(i) HOT DEALS : Subject to Section 6 of this terms and conditions, Participants are able to obtain a reduction in price upon purchasing selected Xiaomi products.

(ii) SPECIAL DEAL: Subject to Section 7 of these terms and conditions, Participants who purchase selected Xiaomi products through our official website will receive a discount coupon for selected Xiaomi products at checkout.

(b) Please note that this Promotion is on first-come first-served basis and while stocks last. This Promotion will only be valid during the Promotional Period and shall be subject to the terms and conditions herein.

6. HOT DEALS

Upon purchasing the selected Xiaomi products listed below, the Participant will automatically receive the specified price reductions. These discounts will be applied to the Participant final purchase price when the Participant proceed to payment for the eligible products. The Promotions on these price reduction deals will only be valid while stocks last.

7. SPECIAL DEAL

Participants who purchase selected Xiaomi products through our official website will receive a discount coupon for selected Xiaomi products upon checkout, subject to the relevant terms and conditions. All items are offered on a first come and first-served basis, while stocks last.

(a)【Coupon】Receive a 10% discount coupon upon placing an order

Participants placing orders in the month of April 2024（1 April 2024 - 30 April 2024) shall receive a 10% discount coupon for their next purchase.

  (i) The discount coupon can only be applied to orders with a value exceeding RM600, with a maximum discount cap of RM100. This coupon cannot be used for purchases of the POCO X6 Pro 5G.

  (ii) The discount coupon is valid for 30 days from the date of receipt. Any coupons not redeemed within this period will automatically expire and cease to be valid.

  (iii) The discount coupons will be automatically credited to the user's account upon confirmation of delivery. The said coupons shall remain valid for a period of 30 days, starting from the 8th day post-delivery, aimed at offsetting any return costs within the initial 7-day period.

  (iv) If an order is cancelled or returned after delivery, the associated coupon will be revoked or rendered invalid. Once a coupon has been used, it cannot be revoked.

The Participant agrees that the Promoter and/or Xiaomi and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Promotion.

(b) Participant agrees and provides consent to the Promoter and/or Xiaomi to the use of any personal data as provided by the Participant for the purpose of participation in this Promotion in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by Promoter and/or Xiaomi for lawful purpose directly related to the running of this Promotion including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Promotion. 11. LIABILITY AND REPRESENTATION

11.1 PROMOTER REPRESENTATION

(a) Unless otherwise expressly stated in this terms and conditions, Promoter and its affiliated or third-party promoters shall carry out this Promotion on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Promoter and its affiliated or third-party promoters do not warrant or represent that: - (i) This Promotion is fit for any purpose or meet Participants requirements or is provided without any errors or deficiencies or that the Promotion in compliance with any quality levels, as the case may be; (ii) This Promotion is available to Participant at any time and provided to Participant without disruption, interruption or delay; (iii) Any information (whether oral or written) obtained by Participant from Promoter or as a result of Participants taking part in the Promotion (including any materials or products) will be suitable, accurate, complete, or reliable; and (iv) That any deficiencies in the Promotion, including any defects in performance, operation or functionality of the Promotion will be fixed, corrected or otherwise remedied.

(b) Participants shall accept the prizes, gifts or coupons under this Promotion as they are. Promoter makes no representation, warranty or undertaking as to any implied terms and conditions with respect to the prizes, gifts or vouchers under this Promotion. Promoter assumes no liability or responsibility in respect to defect or deficiency of the prizes, gifts or vouchers or the nature/consumption of the prizes, gifts or vouchers and will not entertain any direct correspondence with anyone in this regard.

(c) Promoter assumes no responsibility for late entries due to any reasons.

11.2 PROMOTER LIABILITY

(a) Promoter is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Promotion for: - (i) Any indirect, incidental, special or consequential damages; (ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect); (iii) Any damage to and/or corruption or loss of data (whether direct or indirect); (iv) Any changes, modifications, extensions or limitations (including any suspension of Participants) in the Promotion. (v) Access to Participants (account and account data or Participants registration data) taking part of the Promotion, or any permanent or temporary cessation in the terms or conditions of this Promotion (or any part of them).

(b) The Promoter shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Participant in connection or arising from acts or omissions or in any way related to this Promotion or to the nature/consumption of the prizes, gifts or vouchers. (c) The Participant agrees to discharge and release Promoter and/or Xiaomi from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Promotion or to the Participant’s entry in this Promotion or to the nature/consumption of the prizes, gifts or coupons.

(d) The Participant further agrees to discharge and release any third party which is related to and connected with this Promotion from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Promotion or to the Participant’s entry in this Promotion or to the nature/consumption of the prizes, gifts or coupons.

(e) By entering into this Promotion, the Participant agrees to indemnify and hold Promoter and/or Xiaomi, their group of companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by Promoter and/or Xiaomi due to or in any way arising from this Promotion.

(f) The Promoter reserves the rights to modify and/or cancel any of the stated terms and conditions at any time without notice. Participants are encouraged to check from time to time to view any amendments and/or changes made to the stated terms and conditions.

11.3 PARTICIPANTS LIABILITY

(a) The Participant is entirely responsible for any breach of the obligations under: - (i) These terms and conditions; and (ii) For the consequences of any such breach, including any loss or damage which Promoter or any third-party may incur or suffer. Promoter will have no responsibility to Participant or to any third party in respect of such breach.

(b) If Participants are discovered to be using or have used improper means to participate in this Promotion, Promoters reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under full extent of applicable laws.

(c) In the event any prizes, gift or coupons are being awarded to the Participant having provided false or mistaken identity or information, the Promoter shall have the right to revoke the Participant’s eligibility for the said prizes, gift or coupons.

12. LEGISLATION AND APPLICABLE JURISDICTION

The terms and conditions of this Promotion shall be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.
