TERMS AND CONDITIONS

1. ORGANIZATION AND ORGANIZER

1.1 The following terms and conditions (hereinafter, the “Terms” regulate the rules for participating in the Xiaomi activity called “Benefit Package Reservation Event” (hereinafter the “Activity”) which will commence from 10:00 (GMT+8) on 12 September 2024 to 19:00 (GMT+8) on 27 September 2024 (“Activity Period”). 

1.2 The Activity is organized by XIAOMI TECHNOLOGIES MALAYSIA SDN. BHD. a company with its business address at Suite 21-2, Level 21, UOA Corporate Tower, Level 21, Avenue 10, The Vertical, Bangsar South City, No. 8, Jalan Kerinchi, 59200 Kuala Lumpur.(Hereinafter, the "Organizer" or “Xiaomi”) . Organizer reserves the rights to shorten or extend the Activity Period at any time without notice to Participant.

1.3 Participation is voluntary and free of charge, except for internet costs or any other connection costs.

1.5. By taking part in the Activity the Participants hereby accepts:  (i) these Terms, as well as (ii) the Terms of Use of the Organizer (https://www.mi.com/global/support/) and, (iii) the Privacy Policy of the Organizer (https://privacy.mi.com/all/languages/).

1.6. The Activity is in no way sponsored, endorsed, or administered by third-party social media platforms, including but not limited to X, Instagram, and Facebook, which may be used in connection with the Activity. Participants hereby acknowledge and agree to the terms of use, service, or sale and policies of third parties whose platforms are used in connection with the Activity. The Organizer, in particular, points out that Facebook is a trademark registered by Meta Platforms, Inc. and is not responsible for the conduct of the Activity.

2. PLATFORM

2.1 The Participants shall be able to access This Activity through【https://www.mi.com/my/event/2024/xiaomi-launch-September-2024.】

3. PARTICIPANT’S ELIGIBILITY

3.1 This Activity is open to all individuals who are residents in Malaysia, and aged 18 years old and above as of 10:00 (GMT+8) on 12 September 2024 and must have a personal Mi Account or be validly registered on mi.com/my/(“Participant(s)”).

3.2 Upon the Organizer’s request, Participant must be able to demonstrate at any time and, within a reasonable period, that he/she meets the necessary above-mentioned conditions to participate in the Activity.

3.3 The Organizer’s employees and/or their family members up to the second degree or any affiliates or company related to the organization or management of the Activity may not participate in the Activity.

Where inaccurate or erroneous data are provided by the Participant, the Organizer reserves the right to reject or disqualify the Participant from the Activity and so without giving any reasons or notice.

4. PARTICIPATION MECHANISM

4.1 In conjunction with the launching of the Xiaomi 14T Series on 27 September 2024, a pre-heat period will commence sixteen (16) days prior the launch. During this pre-heat period, Participants shall have the chance to obtain various rewards by visiting the pre-heat page via our website at https://www.mi.com/my/event/2024/xiaomi-launch-September-2024 (hereafter referred to as the "Activity Page").

4.2  Participants will be entitled to the following benefits by completing the following via the Activity Page:

· Reward 1: Participants who successfully reserve the Xiaomi 14T Series during the pre-heat period by clicking “reserve” on the Activity Page shall be eligible to receive a RM15 off coupon for orders over RM100 which will be applicable on all Xiaomi products on mi.com/my. All coupons are valid only from 20:00 (GMT+8) on 27 September to 23:59 (GMT+8) on 31 October 2024 and is valid for one time use only. Any voucher not redeemed by 23:59 (GMT+8) on 31 October 2024 will automatically be forfeited and cease to have any effect.

· Reward 2: Participants who successfully subscribed with us via email will be rewarded with 200 Mi points. Please note that Participants will need to log in to their Mi ID in order to receive the Mi points.

4.5  Please note that the coupon rewarded cannot be used in combination with other coupons. It can only be used once (e.g. if you purchase a product using the coupon and subsequently return the product, the coupon shall be void and only the actual amount paid will be refunded). The coupon is personal and non-transferable and cannot be exchanged for cash equivalents. All coupons are offered on first come first serve basis, while stocks last.

5. PERSONAL DATA

5.1 Participants in the Activity agree to provide their respective Organizer with the collection of the following personal data: Mi ID number and Email

5.2 These data shall be collected and processed by the Organizer to ensure the proper organization and management of the Activity i.e. delivery of the benefits.

5.3 The Organizer and its affiliated partner(s) respect the Participant’s privacy and undertake to protect it in accordance with their respective privacy policies and the applicable laws.

5.4 Personal data will be kept for the time necessary to guarantee the Participant with the exercise of their rights and actions in relation to the Activity.

5.5 By providing the personal data, Participant indicates that he/she have read, understood and agreed to be bound by the Privacy Policy stated at https://www.mi.com/my/about/privacy. The Participant agrees that Organizer and/or Xiaomi and/or its agent and/or its third-party service providers may contact them by telephone, email or such other method in connection with this Activity.

5.6 Participant agrees and provides consent to the Organizer and/or Xiaomi to the use of any Personal Data as provided by the Participant for the purpose of participation in this Activity in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by Organizer and/or Xiaomi for lawful purpose directly related to the running of this Activity including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Activity. Ultimately, we want the best for all our Participants. We will be happy to resolve your concerns directly.

6. COMPLAINTS

All complaints related to the Activity can be submitted through the website https://www.mi.com/my/support.

The complaint will be considered within 14 days from the date of its receipt, based on the applicable laws and these Terms. However, the deadline may be extended in the event of reasons beyond the Organizer's control, about which the Participant will be informed.

7. LIABILITY AND REPRESENTATION

7.1 ORGANIZER’S REPRESENTATION

Unless otherwise expressly stated in these Terms, Organizer and its affiliated or third-party Organizers provide the Activity on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party Organizers do not warrant or represent that:

(i) The Activity is fit for any purpose or meet Participant requirements or is provided without any errors or deficiencies or that the Competition in compliance with any quality levels, as the case may be;

(ii) The Activity is available to Participant at any time and provided to Participant without disruption, interruption or delay;

(iii) Any information (whether oral or written) obtained by Participant from Organizer or as a result of Participant taking part in the Activity (including any materials or products) will be suitable, accurate, complete, or reliable; and

(iv) That any deficiencies in the Activity, including any defects in performance, operation or functionality of the Activity will be fixed, corrected or otherwise remedied.

7.2 ORGANIZER’S LIABILITY

Organizer is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the Activity for:

(i)  Any indirect, incidental, special or consequential damages;

(ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

(iii) Any damage to and/or corruption or loss of data (whether direct or indirect);

(iv) Any changes, modifications, extensions or limitations (including any suspension of Participant) in the Activity;

(v) Access to Participant account and account data or Participant registration data taking part of the Activity, or any permanent or temporary cessation in the terms or conditions of the Activity (or any part of them).

In the Activity Period that Organizer is liable for a breach of these Terms, Organizer liability shall be limited to damages which Organizer must typically expect at the time of the conclusion of these Terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than 100 euros (or equivalent local currency).

7.3 PARTICIPANT’S LIABILITY

Participant is entirely responsible for any breach of the obligations under:

(i) These Terms; and

(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the Activity.

For the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

8. FINAL PROVISIONS 

8.1 The content of these Terms is made available to the public on the website and at the Organizer's headquarters.

8.2 Participation in the Activity does not combine with other promotional actions and contests conducted by the Organizer.

8.3 These Terms are the only document setting out the detailed rules of the Activity.

8.4 The Terms of this Activity shall be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the courts of Malaysia.

8.5 Entry in the Activity is tantamount to acceptance of the provisions of the Terms.  

8.6 The Organizer reserves the right to decide on the exclusion of a Participant from the Activity in case of violation of the Terms by a given Participant, attempted fraud, as well as in case of any other conduct of the Participant violating good manners, jeopardizing the good name of the Organizer, its reputation or interests. The excluded Participant forfeits the right to apply for the benefits specified in these Terms, and in the event that they have received a benefit, they are obliged to return it.

8.7 For an important reason, the Organizer may make changes to these Terms. An important reason is in particular:

(a) a change in generally applicable laws or their interpretation by authorized bodies, directly affecting the content of these Terms and resulting in the need to adjust these Terms to such change in laws or their interpretation;

(b) the issuance of a ruling, decision or other similar act by a court or authorized public authority, directly affecting the content of these Terms and resulting in the need to amend these Terms to conform to such ruling, decision or other similar act;

(c) the prevention of violations of these Terms or the prevention of abuse, as well as the removal of ambiguities or doubts of interpretation regarding the content of these Terms;

(d) changes in the names, addresses or corporate data indicated in the content of these Terms;

(e) the need to adapt the technical requirements indicated in these Terms to current standards.

8.8   The Organizer shall inform the Participants of any change to these Terms no later than 7 (seven) days prior to the proposed effective date of the changes to the content of these Terms, subject to paragraph 8.9.

8.9 If an applicable law, ruling or other similar act of an authorized public authority requires the Organizer to amend these Terms within a shorter period of time than indicated in paragraph 8.8, the notification of amendment to these Terms shall indicate such shorter period of time, together with the reason.  

8.10 The amended Terms shall apply to the Participant who does not resign from the Activity before the effective date of the amendment to these erms.  

8.11   An amendment to these Terms shall not adversely affect the conditions of participation in the Activity. The change of these T&C does not affect the rights acquired by the Participant before the change of these Terms.

8.12 These Terms shall be effective as of 12 September 2024.
