Terms and Conditions

The ACT “Smart Choice for Smart TV” offer that M/s Atria Convergence Technologies Limited (ACT) provides to its User is subject to the following Terms of Use. ACT reserves the right to update the Terms of Use at any time and without Notice to User.

TERMS AND CONDITIONS OF THE OFFER

1.Any person who purchases Mi TV from mi.com or from any Xiaomi’s authorized retail store within the period 21st November 2018 to 31st January 2019 (hereinafter referred to as ‘User’) will be entitled to avail an opportunity to avail high speed Broadband internet services of ACT by subscribing to any of the plans mentioned in the table herein below, subject to technical and geographical feasibility as per the below mentioned User Specific Terms and Conditions (herein after referred to as ‘Offer’).

2.Upon User duly fulfilling the Eligibility Criteria and choosing to avail any of the Plans for which the Offer shall apply, shall be entitled to the following upon he/she duly fulfilling the terms and conditions mentioned here under:
a. The User shall be entitled to choose any of the Plans as mentioned against the respective city in which he/she is residing and intends to avail the services from ACT.
b. The User is free to subscribe to various plans/packages offered by ACT on its website www.actcorp.in. However, the Offer mentioned herein shall apply only to the plans mentioned in the table above.
c. The services shall be provided by ACT subject to availability of technical feasibility.
d. All the below mentioned plans shall be provided only on Fixed term basis i.e., 6 months and above.
e. The User will have to pay the entire package subscription charges in advance for the entire duration of the Fixed term (i.e., 6 months and above).
f. Every User as part of the Subscription of the plans mentioned in the table below shall also be entitled to avail free usage of Wi-Fi Router as long as they continue to use the services of ACT. However, this Offer of free usage of Wi-Fi Router shall not apply to existing Customers of ACT.
g. Any User who is intending to avail this offer in the city of Madurai, Tamil Nadu shall not be entitled to get free usage of Wi-Fi router as ACT provides its services using a different technology which does not require a Wi-Fi router
h. The User will have to complete the KYC formalities prescribed by ACT to be eligible to avail the offer.
i. Over and above the specific Package term and FUP prescribed against each of the plans mentioned herein below, the User shall be entitled to receive additional benefit of 2 months of extended term (i.e., 6 months + 2 months of free subscription) and 1500 GB of additional data, which shall be valid only during the 8 months (6 months + 2 months Free) period post which the same shall expire irrespective of the fact as to whether the User has used it or not.

3.This ACT “Smart Choice for Smart TV” offer shall be valid only from 21st November 2018 to 31st January, 2019.

4.Any Eligible User intending to avail this Offer shall duly redeem the Offer within 31st January 2019 failing which the Offer shall stand withdrawn. This Offer shall apply to any existing active subscribers of ACT who are under monthly plans and to existing Fixed term subscribers of ACT whose plan term shall expire during the Offer period.

Eligibility Criteria:

1. Any User who has purchased Mi TV from mi.com or from Xiaomi’s authorised retail store within <> November 2018 to 31st January 2019 and holds a valid invoice issued by towards such television purchase shall submit the following credentials: Name, Mobile no., email Id, complete address, Order ID by visiting this URL //www.actcorp.in/mi_offer

2. Xiaomi shall share with ACT its complete list of order ID and serial nos. of the Mi TVs sold by it once a week so as to enable ACT to validate the eligibility criteria for the Offer.

3. Upon receipt of User credentials, ACT shall compare it with the complete list of Serial No and order ID shared by Xiaomi and validate the Offer at its end. ACT shall also duly check its Geographical & technical feasibility for providing its broadband connection. ACT shall ensure that the process explained in this clause is completed within 10 working days from the date of purchase confirmation by Xiaomi.

Miscellaneous Terms:

1. ACT makes no express or implied representations or warranties, of any kind related to the Offer.

2. ACT undertakes not to divulge the information provided by the User who avails the offer to any third party. It shall be used solely for the purposes of internal management, that is, onboarding the User, invoicing, service delivery etc.,

3. Upon User choosing to submit his credentials under this Offer, the User consents that ACT shall communicate him through SMS, Email and Calls any details pertaining to this Offer or any new Offer ACT may come up from time to time.

4. The User is free to find out about the various plans/packages offered by ACT on its website //www.actcorp.in. The Customer may navigate freely on the pages of the website with no obligation to purchase. However, the offer provided herein shall apply only to the plans mentioned in the table above.

5. Any issue/ complaint with respect to the internet service offered by ACT must first be registered with our customer service department, the contact details of which can be found on the website //www.actcorp.in/customer-care . This is to ensure obtaining amicable solution.

6. The User acknowledges and agrees that ACT shall be solely responsible and liable for all/any disputes, queries, and contentions, raised by the Users in connection with this Offer and Xiaomi shall not be liable in any manner whatsoever. ..

7. Any disputes shall be settled by mutual discussions, failing which the same shall be referred to Arbitration governed by Arbitration and conciliation Act, 1996 as amended from time to time. The Arbitration shall be conducted by a single Arbitrator appointed by ACT. The Language of arbitration shall be English and the place of arbitration shall be Bangalore, India.

8. Subject to clause 6 herein above, this offer shall be governed by Laws of India and courts at Bangalore shall have exclusive jurisdiction.

The User hereby declares that s/he has the capacity to possess rights and be bound by obligations of the above-mentioned Terms and Conditions of Use.
