XiaomiCare保障服務條款

感謝您購買小米手機XiaomiCare保障服務,該服務支持小米或Redmi品牌手機(機型以產品頁為準,以下簡稱「小米手機」)。此服務由Xiaomi H.K. Limited(以下簡稱“小米”或“本公司”)提供,請仔細閱讀加粗的條款內容。若您不接受本服務條款或對本服務條款存在異議,請立即停止操作。您購買XiaomiCare行為,即視為獲得您的認可並同意接受本條款協議的所有內容。

第一條 服務範圍

XiaomiCare服務有效期內您可到指定維修點<旺角維修中心>,可享有以下權益:
1.意外無憂服務: 意外損壞或進液導致機械或電子故障或產品缺陷,二年內可享受每年二次維修服務(當年未使用不疊加不順延)若符合維修標準可進行維修,檢測若判定手機無法修復或無維修價值的,收取約定服務費將為您置換同款或相同性能的新機。每次維修或換新均收取HK$ 599服務費。換新後將繼承原手機綁定的XiaomiCare剩餘次數及年限。
2.碎屏無憂服務:手機屏幕發生破碎(不包含屏幕外故障),可享受每年二次維修服務,每次收取HK$ 299服務費。
碎屏無憂、意外無憂的維修次數為疊加計算,每年維修和換新總次數不超過二次。
若未支付服務費本公司將無法為您提供服務,且不承擔任何責任。
3.延長保修服務:手機發生質量故障且無法正常使用的(不包含意外人為損壞),則您可在廠保結束後的一年內,可獲得多次維修服務。
4.更換電池服務:手機發生質量故障(不包含意外人為損壞)廠保結束後一年內,可獲得一次免費更換電池服務。
5.服務範圍適用於在香港地區官方授權渠道所購買設備,僅可在香港地區進行的維修。

第二條 本"XiaomiCare保障服務"的有效期:

1.XiaomiCare保障服務隨新機購買時,自您綁定服務的小米手機妥投次日零時起生效,服務期限為兩年。
2.XiaomiCare-意外無憂服務自生效之日起生效,保障期限為二年;
3.XiaomiCare-碎屏無憂服務自生效之日起生效,保障期限為二年;
4.XiaomiCare -延長保修服務和更換電池服務自手機整機廠保結束次日零時起生效,保障期限為一年;

第三條 不在"XiaomiCare保障服務"範圍的情形

(一)發生下列任一情形,您將無法享受本XiaomiCare保障服務:
1.您的故意行為導致的手機損壞;
2.不影響手機基本使用功能的附件或耗材,包括不限於存儲卡、耳機、充電設備、資料線、書寫筆等的磨損、損耗、損壞或滅失;
3.電腦病毒、其他惡意編碼或類似指令破壞手機的正常功用或造成的手機資料、程式的毀損或失效;
4.手機在外觀上的瑕疵,如脫漆、刮痕、褪色等,但若手機因發生保障服務範圍內的損失而導致上述情形的,則不在此限;
5.非手機的基本功能所需的資料、程式、軟體的丟失和損壞等;
6.因手機意外受損導致的任何間接損失或附帶損失(包括但不限於無法使用、業務損失、利潤損失、資料損失、故障時間損失及誤工費等);
7.無法識別您送修的手機型號、IMEI識別碼,或您送修的手機型號、IMEI識別碼等存在塗改、缺失、無法辨識或與購買本保障服務時所記載的不符;
8.您的手機已經過非官方授權維修店進行拆機的;
9.因被盜、被搶、遺失等原因導致的手機整件滅失的;
10.您未在本公司指定或書面同意的維修點進行維修或置換的;
11.您維修或置換的請求不在XiaomiCare保障服務期限或約定的服務時效內;
12.戰爭、敵對行動、軍事行為、武裝衝突、罷工、騷亂、暴動、恐怖活動;
13.行政行為或司法行為;
14.颱風、洪水、地震、火山爆發或海嘯、核反應、核輻射或放射性汙染;
15.您未能支付手機服務費用的;
16.用於商業性使用、共享使用、營利性使用或多個家庭間使用的;

(二)下列的損失或費用,也均不屬於XiaomiCare保障服務的範圍:

1.超出本XiaomiCare保障服務約定的保障範圍外的維修及費用;
2.因手機造成您或其他任何人員的人身損害和/或財產損失和/或任何經濟性利益的損失;
3.您發生的任何與本服務條款有關的訴訟、仲裁以及相關費用;
4.發生在中華人民共和國香港特別行政區以外的損失。

第四條 "XiaomiCare保障服務"購買須知

1.在XiaomiCare保障服務期間內,您綁定手機如因主板更換或手機換貨導致手機串號改變,則您須提供小米官方授權維修網點維修證明或換貨證明,如您無法提供綁定時的手機串號或串號變更證明,本公司將無法為您提供維修服務。
2.您的手機因意外事故導致的受損、或發生質量問題無法正常使用時,可在撥打852-30773620報修。報修時請提供您本人的信息(購買人姓名、聯系電話)及綁定XiaomiCare的手機信息(品牌、機型、串號)。未能提供前述信息的,本公司有權不接受報修並不提供維修服務。
3.XiaomiCare的碎屏無憂、意外無憂需收取條款中約定服務費,未付款或付款失敗本公司有權不提供維修服務,本公司均不以現金方式對您提供賠償。
4.使用XiaomiCare-意外無憂權益換新的手機不支持退機,不再支持對新手機購買XiaomiCare保障服務。
5.您在報修後,需送修到小米指定維修點。如送修逾期您需要重新報修並提前預約到店維修時間,並在預約時間內將手機送至<旺角維修中心>。
6.XiaomiCare服務過程中,檢測出手機被非小米指定維修點進行拆機,則本公司將不再為您提供任何服務,且不退還購買本XiaomiCare保障服務的相關費用。
7.維修時長一般為1-3個工作日,維修完成後,將會通知您前往<旺角維修中心>領取手機。
8.您手機送修之前,請務必關閉小米雲服務、取消設備的開機或者使用密碼,否則將影響本公司為您提供XiaomiCare服務。同時,維修過程不能確保您手機內的信息數據安全,故如您有重要的信息、文件、資料、圖片等的,請您先行備案或刪除後再行送修。如因您未執行此操作導致您資料損失和/或個人信息泄露的,一切責任及後果將由您自行承擔。
9.本公司維修或置換下來的零配件的廢料歸屬權為本公司。
10.若本公司如發現您存在欺詐行為,本公司有權不提供任何服務並訴諸法律。

第五條XiaomiCare保障服務的退貨與轉讓

1.若在交易成功之日起7天內您發生手機退貨,且您未使用XiaomiCare中的任一服務權益,則可以申請本XiaomiCare退款。
2.若已使用XiaomiCare中任一服務權益,無論手機因任何原因發生退貨,本Xiaomi Care保障不支持單獨退款。
3.您購買的XiaomiCare在未退機的情況下生效7天後,不再接受任何原因的退款。
4.本XiaomiCare一經售出不能轉讓;若通過小米商城、小米之家購買的小米手機發生換貨時,XiaomiCare會自動更新到新設備上;若串號換串失敗,請聯系小米客服852-30773620申請換串。XiaomiCare更新至新設備後,保障期限不變,為原手機XiaomiCare的剩余維修次數和保障期限。

第六條XiaomiCare保障服務的終止:

有下列情形之一的,「XiaomiCare保障服務」自然終止:
1.已超出本服務協議約定的XiaomiCare有效日期的;
2.您綁定XiaomiCare的手機在非本公司指定維修點維修或置換的;
3.您綁定XiaomiCare的手機按XiaomiCare 碎屏無憂、意外無憂條款的規定每年已享受過2次免費維修或換新服務的,當年碎屏無憂、意外無憂權益終止。若權益未使用但每年保障到期,當年碎屏無憂、意外無憂權益終止,維修次數不順延。
4.您綁定XiaomiCare的手機按XiaomiCare-換電池服務條款的規定已享受過一次免檢免費更換電池服務的,更換電池服務終止;
5.如發現您故意損壞購買"XiaomiCare "的手機,則該XiaomiCare自動終止,本公司不退還任何費用。如涉及通過製造事故騙取不當利益的,則本公司保留追究該用戶法律責任的權利。

第七條 個人資料收集聲明:

當您購買XiaomiCare保障服務及申請維修服務時,您同意我們收集包括但不限於您的姓名、手機號碼、小米ID等個人信息,手機相關信息(如IMEI、型號等)、服務訂單信息(如服務費、生效時間、保障起止期等)、申請維修信息(如意外損壞原因、損壞部位、故障描述、維修用料明細、手機損壞圖片、總計費用等)等為您提供您選定的相應服務,我們尊重並保護您的個人隱私,並將按小米統一隱私政策(https://www.mi.com/hk/about/privacy)保護您的信息。同時,您同意您的上述相應信息可能被披露、分享或轉移至香港境內或境外的關聯公司或第三方服務提供商(包括手機維修商、保險經紀、保險公司等),目的是為了向您提供XiaomiCare保障服务。請您放心,我們僅會出於合法正當、特定必要且明確的目的共享您的信息。

A:目前僅支持小米商城、小米之家直營店購買手機時一同下單購買本服務。

Q:什麼情況下可以使用小米手機XiaomiCare保障服務?

A:XiaomiCare保障服務所綁定的手機,在日常使用過程及保障服務有效期內,由於非人為因素屏幕碎裂、意外入水、受壓損壞,或出現質量故障、電池故障可享受維修服務。

Q:當手機發生意外損壞時,如何維修?

A:手機發生質量電池故障時,您需自行前往<旺角維修中心>進行維修,經檢測在保障範圍內,廠保結束一年內為你提供一次維修服務,具體以維修中心檢測結果為準。

Q:碎屏無憂、意外無憂收取的服務費是什麽?

A:經<旺角維修中心>檢測,設備意外損壞、屏幕破裂或無法維修或不具備維修價值時,您需支付服務費進行維修或置換新機。具體服務費金額參見《服務條款》。

Q:維修後,個人數據會丟失嗎?

A:可能會。建議您在維修前對小米手機內所有的個人數據進行雲端備份,並退出小米賬號,清除本地數據。小米公司對您小米手機內個人數據的丟失不承擔任何責任。

Q:手機在購買XiaomiCare保障服務後發生廠保範圍內的換貨,會影響服務的使用嗎?

A:通過小米商城、小米之家購買的手機,保障服務會自動更新到新設備上,不會影響本服務的使用。

Q:本服務是否可以退出或轉讓?

A:除《服務條款》所述情形外,XiaomiCare保障服務不支持退出或轉讓。

Q:手機使用碎屏無憂、意外無憂服務之後,還享受廠保嗎?

1)如發生手機維修,後續是否能繼續享受廠保,需以維修中心最終檢測結果為準。 2) 如發生置換新機的情況,則置換的新機不支持退機,但可享受7天內質量問題換貨,且置換後新機的廠保從激活開始計算,依然享受12個月的質量維修。

XiaomiCare ProtectionTerms of Service

Thank you for purchasing Xiaomi mobile phone XiaomiCare protection service, which supports Xiaomi or Redmi brand mobile phone (the model is subject to the product page, referred to as "Xiaomi mobile phone"). This service is provided by Xiaomi H.K. Limited (the company), please read the terms in bold. If you do not accept these terms or have any objection to these terms, please stop operating immediately. By purchasing XiaomiCare, you are deemed to have obtained your approval and agreed to accept all the contents of these terms.

Article 1 Service Scope

Within XiaomiCare service validity, you can go to the designated repair point and enjoy the following benefits:

  1. Accidental worry-free service: Accidental damage or liquid ingress leads to mechanical or electronic failures or product defects. Within two years, you can enjoy secondary maintenance services every year (not used in the current year, not superimposed and not postponed). If the maintenance standards are met, maintenance can be carried out. If it is determined that the mobile phone cannot be repaired or has no maintenance value, the agreed service fee will be replaced by a new phone of the same model or performance. A service fee of HK$ 599 will be charged for each repair or replacement. After the replacement, the remaining times and years of XiaomiCare bound to the original phone will be inherited.
  2. Broken screen worry-free service: If the mobile phone screen is broken (excluding off-screen faults), you can enjoy the maintenance service twice a year, and a service fee of HK$ 299 will be charged each time.
    The number of repairs for broken screen worry-free and accidental worry-free is calculated as a superposition, and the total number of repairs and replacements per year is no more than two times.
    If the service fee is not paid, the company will not be able to provide you with services, and will not assume any responsibility.
  3. Extended warranty service: If the mobile phone has a quality failure and cannot be used normally (excluding accidental man-made damage), you can obtain multiple maintenance services within one year after the end of the factory warranty.
  4. Battery replacement service: If the mobile phone has a quality failure (excluding accidental man-made damage), within one year after the end of the factory warranty, you can get a free battery replacement service.
  5. The scope of service applies to equipment purchased in Hong Kong through Xiaomi authorized sale channels, and can only be repaired in Hong Kong.

    Article 2 The validity period of this "XiaomiCare ProtectionProtection Service":

  6. When the XiaomiCare Protection Service is purchased with a new phone, it will take effect from 0:00 on the next day when the Xiaomi phone you bound to the service is properly invested, and the service period is two years.
  7. XiaomiCare-Accidental Worry-Free Service will take effect from the effective date, and the guarantee period is two years;
  8. XiaomiCare-Broken Screen Worry-free Service will take effect from the date of entry into force, and the guarantee period is two years;
  9. XiaomiCare - extended warranty service and battery replacement service will take effect from 0:00 on the next day after the end of the factory warranty of the mobile phone, and the warranty period is one year;

Article 3 Circumstances not covered by "XiaomiCare Protection Service"

(1) In the event of any of the following circumstances, you will not be able to enjoy the XiaomiCare Protection Service:

  1. Damage to the phone caused by your intentional behavior;
  2. Accessories or consumables that do not affect the basic functions of the mobile phone, including but not limited to wear, tear, damage or loss of memory cards, earphones, charging equipment, data cables, writing pens, etc.;
  3. Computer viruses, other malicious codes or similar instructions destroy the normal functions of the mobile phone or cause damage or failure of mobile phone data and programs;
  4. Defects in the appearance of the mobile phone, such as peeling paint, scratches, fading, etc., but if the above situation is caused by the loss of the mobile phone within the scope of the guaranteed service, this is not limited;
  5. Loss and damage of data, programs and software not required for the basic functions of the mobile phone;
  6. Any indirect loss or incidental loss caused by accidental damage to the mobile phone (including but not limited to inability to use, loss of business, loss of profit, loss of data, , loss of failure time and cost of missed work, etc.);
  7. The model of the mobile phone you sent, the IMEI identification code, etc. are altered, missing, unrecognizable or inconsistent with those recorded when purchasing this XiaomiCare Protection Service;;
  8. Your mobile phone has been disassembled by an unofficial authorized repair shop;
  9. The entire mobile phone is lost due to theft, robbery, loss, etc.;
  10. You have not repaired or replaced at the repair point designated or agreed by the company in writing;
  11. Your request for repair or replacement is not within the XiaomiCare Protection Service period or the agreed service limitation period;
  12. Wars, hostilities, military acts, armed conflicts, strikes, riots, riots, terrorist activities;
  13. Administrative or judicial acts;
  14. Typhoon, flood, earthquake, volcanic eruption or tsunami, nuclear reaction, nuclear radiation or radioactive contamination;
  15. You fail to pay for the mobile phone service;
  16. For commercial use, shared use, for-profit use or use among multiple families;

    (2) The following losses or expenses are not within the scope of XiaomiCare's Protection Services:

  17. Repairs and expenses that exceed the coverage scope agreed in this XiaomiCare warranty service;
  18. Personal injury and/or property loss and/or loss of any economic benefit to you or any other person caused by the mobile phone;
  19. Any litigation, arbitration and related expenses incurred by you in connection with these Terms of Service;
  20. Losses occurring outside Hong Kong SAR of People's Republic of China.

    Article 4 "XiaomiCare Protection Service" Purchase Instructions

  21. During the XiaomiCare Protection Service period, if the serial number of your mobile phone changes due to motherboard replacement or mobile phone replacement, you must provide a repair certificate or replacement certificate from an official Xiaomi authorized repair site. If you cannot provide the binding The mobile phone serial number or serial number change certificate, the company will not be able to provide you with maintenance services.
  22. When your mobile phone is damaged due to an accident or cannot be used normally due to quality problems, you can call 852-30773620 for repair. When applying for repairs, please provide your personal information (purchaser name, contact number) and the mobile phone information (brand, model, serial number) bound to XiaomiCare. If you fail to provide foresaid information, the company has the right not to accept the repair request and not to provide maintenance services.
  23. XiaomiCare has the right to not provide maintenance services for non-payment or failure of payment, and the company will not provide you with compensation in cash.
  24. Using XiaomiCare-Accidental Worry-free benefits to replace the new mobile phone does not support the return of the phone, and the purchase of XiaomiCare Protection Services is no longer supported.
  25. After you apply for repair, you need to send it to Xiaomi's designated repair point. If the repair is overdue, you need to re-apply for repair and make an appointment in advance for the repair time at the store, and send the mobile phone to the within the appointment time.
  26. During the XiaomiCare service process, if it is detected that the mobile phone has been disassembled by a non-Xiaomi designated maintenance point, the company will no longer provide you with any services, and will not refund the relevant fees for purchasing this XiaomiCare warranty service.
  27. The repair time is generally 1-3 working days. After the repair is completed, you will be notified to go to the to pick up the phone.
  28. Before sending your mobile phone for repair, please be sure to turn off the Xiaomi cloud service, cancel the power-on of the device or use the password, otherwise it will affect the company's provision of XiaomiCare services for you. At the same time, the maintenance process cannot ensure the security of the information and data in your mobile phone, so if you have important information, documents, materials, pictures, etc., please file or delete it before sending it for repair. If your data loss and/or personal information is leaked due to your failure to perform this operation, all responsibilities and consequences will be borne by you.
  29. The company has the right to the ownership of the waste of the spare parts repaired or replaced by the company.
  30. If the company finds that you have committed fraud, the company has the right not to provide any services and to resort to law.

    Article 5 Return and Transfer of XiaomiCare Protection Service

  31. If you return your mobile phone within 7 days from the successful transaction date, and you have not used any service benefits in XiaomiCare, you can apply for a refund of this XiaomiCare.
  32. If you have used any service benefits of XiaomiCare, no matter if the phone is returned for any reason, this XiaomiCare does not support a separate refund.
  33. After the XiaomiCare you purchased is valid for 7 days without being returned, no refunds will be accepted for any reason.
  34. This XiaomiCare cannot be transferred once it is sold; if the Xiaomi mobile phone purchased through Xiaomi Mall or Xiaomi Home is exchanged, XiaomiCare will be automatically updated to the new device; if the serial number change fails, please contact Xiaomi customer service 852-30773620 to apply for a replacement string. After XiaomiCare is updated to a new device, the warranty period remains unchanged, which is the remaining repair times and warranty period of the original XiaomiCare phone.

    Article 6 Termination of XiaomiCare Protection Service:

    In any of the following circumstances, the "XiaomiCare Protection Service" will be terminated naturally:
  35. The XiaomiCare validity date stipulated in this service agreement has exceeded;
  36. Your phone bound to XiaomiCare is repaired or replaced at a repair point not designated by the company;
  37. If your mobile phone bound to XiaomiCare has enjoyed 2 free maintenance or replacement services per year according to the provisions of XiaomiCare's worry-free screen and accident-free clause, the rights of worry-free screen and worry-free accident will be terminated in that year. If the rights are not used but the guarantee expires every year, the rights of worry-free screen breakage and worry-free accident will be terminated in that year, and the number of repairs will not be postponed.
  38. If your mobile phone bound to XiaomiCare has already enjoyed a free battery replacement service without inspection according to the provisions of XiaomiCare-battery replacement service terms, the battery replacement service will be terminated;
  39. If it is found that you have intentionally damaged the mobile phone you purchased "XiaomiCare", the XiaomiCare will be automatically terminated and the company will not refund any fees. If it involves defrauding improper benefits through manufacturing accidents, the company reserves the right to pursue the legal responsibility of the user.

    Article 7 Personal Data Collection Statement

    When you purchase XiaomiCare Protect Service and apply for repair service, you agree to Xiaomi’s collection of your personal information including but not limited to your name, mobile phone number, Xiaomi ID, mobile phone related information (such as IMEI, model, etc.), service order information (such as service fees, effective time, start and end period, etc.), application for maintenance information (such as accidental damage, damaged parts, fault description, repair materials details, mobile phone damage pictures, total fees, etc.), etc., to provide you with the corresponding services you choose. We respect and protect your personal privacy and will protect your information in accordance with Xiaomi's unified privacy policy(https://www.mi.com/hk/about/privacy). You also agree that your information above may be disclosed, shared, divulged, supplied or transferred to affiliates or third party service providers within or outside Hong Kong (including but not limited to mobile phone repairers, insurance brokers, insurance companies, insurance service providers etc.), in order to provide you with XiaomiCare protection services. Please be assured that we will only share your information for legitimate and specific purposes.

    FAQ

    Q: Where can I buy XiaomiCare protection service for Xiaomi phones?

    A: Currently, only Xiaomi Mall and Xiaomi Home can place an order to purchase this service when purchasing a mobile phone.

    Q: Under what circumstances can Xiaomi mobile phone XiaomiCare protection service be used?

    A: When the mobile phone that is bound to XiaomiCare Protection Service, in the process of daily use and during the XiaomiCare Protection Service period, due to non-human factors, the screen is broken, accidentally entered into water, damaged by pressure, or has quality failure, battery failure can enjoy maintenance services.

    A: When the quality battery of the mobile phone fails, you need to go to the for repairs by yourself. After testing, it is within the scope of protection. After the factory warranty expires, we will provide you with one-time repair service. The specific test results of the repair center shall prevail.

    Q: What is the service fee charged for Broken Screen Worry-free and Accidental Worry-free?

    A: When the detects that the equipment is accidentally damaged, the screen is broken or cannot be repaired or has no repair value, you need to pay a service fee to repair it or replace it with a new one. Please refer to the "Terms of Service" for specific service fee amounts.

    Q: Will personal data be lost after repair?

    A: Probably. It is recommended that you make a cloud backup of all personal data in the Xiaomi phone before repairing, log out of the Xiaomi account, and clear the local data. Xiaomi Corporation is not responsible for the loss of personal data in your Xiaomi phone.

    Q: After purchasing the XiaomiCare warranty service, the phone is replaced within the scope of the factory warranty, will it affect the use of the service?

    A: For mobile phones purchased through Xiaomi Mall and Xiaomi Home, the Protection Service will be automatically updated to the new device, which will not affect the use of this service.

    Q: Can this service be withdrawn or transferred?

    A: The XiaomiCare protection service does not support withdrawal or transfer unless differently mentioned in the “Terms of Service”.

    Q: After using the mobile phone with worry-free screen and accident-free service, do you still enjoy factory warranty?

    1) In the event of a mobile phone repair, whether you can continue to enjoy the factory warranty in the future depends on the final test result of the repair center.     2) In the event of replacement of a new machine, the replaced new machine does not support returning the machine, but can enjoy the replacement within 7 days of quality problems, and the factory warranty of the new machine after the replacement is calculated from the activation, and still enjoys 12 months.
